    I recently received a notice from ssa on class clark v astrue, Since I didn’t receive disability benefits from July 2007 through August 2008 due to a warrant at the time do I receive backpay from this Class .

  2. my checked was stopped in 2005 cause of a felony warrant in fl they made me pay back 13000 in over payment for a fl instate warrant only warrant I went to court in front of a judge and was denied benefits do they owe me all this money and back pay n if so how long does it take to receive it thank you.

        I was approved for ssi disability in october 2001. In 2002 my ssi disability was stopped due to a warrant for violation of parole.
        I filed a appeal at that time and of course the appeal was denied.
        Last year I again was approved for SSI disability and was granted backpay from my filing date of june 2010. SSI then took my back pay away because they said they overpaid me in 2001 because I was not eligable in 2001 due to the warrarnt for viloation of parole.
        I filed a appeal with SSI on this matter again about 9 months ago over them taking away my backpay and it was denied. They took $4700.00 of my backpay. I even went to a appointment at SSI office and talked to them over the matter. Thet stated due to the fact that I had a violation of parole in 2001/2002 that they were taking away my back pay from this latest approval of Backpay.
        Now I see this Court decision.
        I have have a terminal illness for over 27 years now and the Judge found that I was disabled and stated in the letter the same findings that the judge found in 2001.
        I am wondering if I qualify under clark Vs Astrue.
        Pleas inform me as to what I should do.
        I did receive a letter dated February 25, 2013 for SSI stating that I MAY qualify and that another letter MAy be sent to me if I do Qualify.

          The instructions I have received from the local SSA office is they are awaiting instructions from the national office on how to properly handle these cases. If you received a letter from SSA, we are being told to instruct individuals to contact their local SSA office and ask for a supervisor if you have difficulty.

    I was taking off ss for a mental disorder around the second month of 2009 for a warrant of a misdemeanor probation violation, will i be receiving my back pay?

    to whom concern, in year of 06 or07 my checks were suspended for miss. probation violation though the court system there were no warrant for my arrest, but ssa still suspended my checks up til 4-08 or longer. since the suspended i ve lost everything i had, also were homeless until i got out on 2-09. also i feel that i were under paid. is there a possibility of refunds.
